Can you Airbnb in Beekman, NY?

Effectively prohibited

Researched and reviewed by Jake Lee, FounderCurrent as of July 2026How this atlas is maintained

Beekman effectively bans whole-home short-term rentals: the town's 2022 law prohibits unhosted rentals townwide and does not permit renting an entire home for stays under 30 days. Only hosted rentals are allowed, meaning the owner rents out a portion of their primary residence and stays in the home overnight with guests, under an annual town permit with inspections. A typical owner-absent whole-home Airbnb cannot legally operate in Beekman.

What the rules say in Beekman

  • A short-term rental is defined as a portion of a single-family dwelling rented for fewer than 30 consecutive days; the definition expressly excludes rental of the entirety of a single-family dwelling for under 30 days (Ch. 126.1, Section 126.1-2)
  • Unhosted short-term rentals, where the owner is not present in the dwelling overnight with guests, are prohibited townwide (Sections 126.1-2 and 155-39.1(B))
  • Hosted short-term rentals are permitted only as an accessory use to a single-family dwelling that is the owner's primary residence, in all zoning districts (Section 155-39.1(C))
  • An annual short-term rental permit from the Building Department is required before operating or advertising, expiring December 31 each year, with non-refundable application, inspection, and permit fees per the town Schedule of Fees (Sections 126.1-3 to 126.1-5)
  • A Building Inspector inspection is required at initial application and before each renewal, checking smoke and CO detectors, fire extinguisher, and two means of egress per rented bedroom (Section 126.1-5(B))
  • An owner may operate a short-term rental on only one parcel in town, and permits are non-transferable to other owners or properties (Section 126.1-7(A) and (B))
  • Maximum two guests per bedroom (children under 5 excluded); bedrooms must be at least 70 sq ft for one person or 100 sq ft for two (Section 126.1-7(E)(5) and (6))
  • No assemblies such as weddings, parties, or banquets; no signage; no renting accessory structures, RVs, tents, or non-habitable spaces; no separate pool, hot tub, or yard rentals (Section 126.1-7(E))
  • The town permit number must appear in any online or print listing, and listing on Airbnb or VRBO creates a rebuttable presumption of STR use (Section 126.1-3(C) and (D))
  • Owners must keep a 3-year guest registry and pay the Dutchess County hotel occupancy tax (Section 126.1-7(E))
  • Civil penalties: $350 to $500 for a first offense, $500 to $5,000 for subsequent offenses, with each violation counted separately (Section 126.1-15)

How short-term rentals are regulated in New York

  • New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
  • Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
  • Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
