Short-term-rental rules

Can you Airbnb in Carmel, NY?

Heavily restricted

Researched and reviewed by Jake Lee, FounderCurrent as of July 2026How this atlas is maintained

Carmel's zoning code, adopted March 5, 2025, only allows short-term rentals in owner-occupied single-family homes, so a typical non-owner-occupied whole-home Airbnb does not qualify at all. Owners who do qualify need a special use permit and site plan approval from the Planning Board plus a Building Department license, and the lot must be at least 3 acres. Stays are capped at 14 consecutive days, with a maximum of 4 rented bedrooms and 2 guests per bedroom.

Can I run a short-term rental in Carmel, NY?

No go for nightly stays

The rule that closes it: An STR is defined as a single-family detached OWNER-OCCUPIED dwelling (or accessory building on the same lot) rented for no more than 14 consecutive days; hotels, campsites, and glamping are excluded (§ 156-8 definition). Non-owner-occupied whole-home rentals fall outside the definition.

Is there a legal way to rent short-term in Carmel?
Most ordinances of this kind restrict stays under 30 nights and leave longer furnished rentals alone, so a 30-plus-night rental is usually the compliant route in Carmel. Confirm the specifics against the sources on this page before you rely on it.

What would you do with a property in Carmel?

Not for nightly stays. The compliant play in Carmel is a furnished rental of 30 nights or more, which most ordinances of this kind leave open, and which we can set up and run. If you are buying specifically to run nightly stays, buy somewhere else.

What the rules say in Carmel

  • An STR is defined as a single-family detached OWNER-OCCUPIED dwelling (or accessory building on the same lot) rented for no more than 14 consecutive days; hotels, campsites, and glamping are excluded (§ 156-8 definition). Non-owner-occupied whole-home rentals fall outside the definition.
  • An STR requires a special use permit and site plan approval from the Planning Board (§ 156-36.4.A).
  • The operator must also obtain a license from the Town Building Department, renewed annually, with periodic safety inspections and 24/7 emergency contact info (§ 156-36.4.B(12)-(13)).
  • Minimum lot area is 3 acres, and the Planning Board may require more; the lot must otherwise comply with the district's bulk schedule (§ 156-36.4.B(3)).
  • Maximum 4 bedrooms may be rented and no more than 2 persons per bedroom; a floor plan identifying guest bedrooms is required with the application (§ 156-36.4.B(1)).
  • Length of stay is limited to 14 consecutive days per guest (§ 156-36.4.B(5)).
  • An STR is not permitted if access is only from a private road; the driveway must have direct access to a public road over the owner's land (§ 156-36.4.B(4)).
  • Operational requirements: guest registry and financial records, no outdoor large gatherings/weddings/events, 1 extra parking space per rented bedroom, regular waste removal, certification that well and septic can handle the added load, and a Planning-Board-approved good-neighbor brochure posted on any listing site (§ 156-36.4.B(6)-(11), (15)).
  • The Town Board may cap the total number of STRs in the town by resolution (§ 156-36.4.B(16)).
  • Existing unpermitted operators had 90 days from the effective date to apply; operating without approval after that is a violation requiring immediate cessation (§ 156-36.4.B(17)).
  • Penalties escalate from up to $500 (first conviction) to $1,000 plus 6-month suspension, $1,500 plus 1-year suspension, then revocation of the permit and special use permit (§ 156-36.4.B(18)).

How short-term rentals are regulated in New York

  • New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
  • Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
  • Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
