The Town of Blooming Grove bans short-term rentals outright. Under Section 235-12.1 of the town zoning code (adopted 2017), renting any home or part of a home for under 30 consecutive nights is unlawful in all residential districts, covering single-family, two-family, and multi-family dwellings alike. The only carve-outs are lawfully licensed hotels, motels, and bed-and-breakfasts, so a typical whole-home Airbnb cannot operate legally here.

What the rules say in Blooming Grove

  • Short-term rental is defined as a dwelling unit rented, in whole or in part, for a period of less than 29 consecutive nights; a 'transient' rental period is 29 nights or less (§ 235-12.1B).
  • It is unlawful in any residentially zoned district to rent, license, or offer to rent any living accommodations for compensation for a period of less than 30 consecutive nights unless the accommodations are lawfully licensed or permitted for such use under the Town Zoning Code (§ 235-12.1C(1)).
  • Occupants may not stay in living accommodations for under 30 consecutive nights in exchange for compensation, and lease clauses waiving the law are void (§ 235-12.1C(2)-(3)).
  • The prohibition applies to all single-family, two-family, and multiple-family residential dwellings in the town (§ 235-12.1D(1)).
  • Only exemptions: commercial hotel/motel businesses and bed-and-breakfast establishments operating exclusively as such and lawfully licensed or permitted under the Town Zoning Code (§ 235-12.1D(2)).
  • Guests who rent from a violating owner are deemed accessories to the offense (§ 235-12.1C(5)).
  • Enforcement: first violation draws a warning from the Building Inspector; subsequent violations are subject to penalties under § 235-84, and the town may also seek injunctive relief (§ 235-12.1C(6)-(7)).

How short-term rentals are regulated in New York

  • New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
  • Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
  • Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
