The Town of Crawford bans short-term rentals outright. Local Law No. 8-2024, codified as Chapter 112 of the town code, prohibits renting any dwelling for under 30 consecutive days anywhere in town, with no permits available and no grandfathering for existing Airbnbs. Violations carry criminal and civil penalties of up to $500 per day each, and even listing a property on Airbnb or Vrbo creates a legal presumption of violation.

What the rules say in Crawford

  • Section 112-4 states: short-term rentals are prohibited in the Town of Crawford. This is a town-wide ban, not a permit scheme.
  • Section 112-2 defines a short-term rental as any building, dwelling unit, or portion of real property rented for compensation for a period of less than 30 consecutive days, explicitly including rentals via Airbnb, HomeAway, and Vrbo. Month-to-month tenancies are excluded.
  • Section 112-3 makes offering all or part of a property on a short-term rental website, or advertising it for under 30 days, a rebuttable presumption that the property is operating as a short-term rental.
  • Section 112-5 denies grandfathering: any short-term rental existing before the chapter took effect is unlawful and gains no vested rights or lawful nonconforming-use status.
  • Section 112-4 also prohibits renting out a private residential pool, yard, sports court, or other amenity (Swimply-style rentals).
  • Section 112-6 penalties: criminal fine up to $500 per day and/or up to 15 days imprisonment, a separate civil penalty up to $500 per day, injunctive relief, and disgorgement of up to double the profit gained. Each day is a separate violation.

How short-term rentals are regulated in New York

  • New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
  • Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
  • Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
