  • Tenants may not sublease their unit as an STR; only the property owner may establish an STR.
  • A 24/7 responsible party (owner or agent) is required, must reside in the local area, and must be able to respond in person within 2 hours.
  • Guest vehicles capped at one per two occupants; smoke detector certification from Harrison Fire Prevention, proof of general liability insurance, and current town taxes/water/sewer required; violations can bring fines and permit revocation.
  • Background zoning: the Land Development Ordinance is permissive (secs. 17-4, 17-81.6: any use not expressly permitted is prohibited), and hotel/transient-lodging use is only a listed permitted use in the Waterfront Redevelopment Area zone, so before Ord. 1550 STRs had no lawful path in residential zones.
