What the rules say in Village of New Square

  • Village zoning is exclusive: Zoning Law sec. 4.2.B states no structure or land shall be used except as provided in the annexed Use Table, so unlisted uses are not permitted.
  • The R-Residential district's Table of Use Regulations lists only residential dwellings, schools, religious uses, public utilities, village uses, and government offices as permitted uses (plus special-permit multifamily of 5+ units, nursing or convalescent homes, neighborhood/community centers, and hospital clinics); no transient-occupancy, short-term-rental, tourist home, bed-and-breakfast, or boarding/rooming use appears anywhere in the law.
  • Sec. 2.2 defines Hotel and Motel as facilities offering transient lodging accommodations to the general public for a term of less than 90 days; Hotel is allowed only as a special-permit use in the NS-Neighborhood Shopping district and a permitted use in the C-Commercial district (all uses subject to Planning Board site plan approval), and Motel is defined but listed in no district.
  • Effect: renting a dwelling for under ~30 consecutive nights is transient lodging, which is not a permitted use in the Residential district; the only lawful transient-lodging avenue in the village is a bona fide hotel in the NS or C commercial districts.
  • The 2023 law repealed and replaced Local Law No. 1 of 1967 as amended by Local Law No. 1 of 2007 in its entirety and took effect upon filing with the NY Secretary of State.
  • No village short-term-rental local law, rental registry, or rental permit program exists on the village website; searches of newsquare-ny.gov for 'rental' and 'short-term' return no results, and New Square's code is not published on eCode360/General Code.
  • Home occupations are allowed as accessory uses in dwellings but cover only occupations or professions incidental to residential use, not lodging of transient guests.
