The City of Poughkeepsie requires a permit for any rental under 30 days and allows only two types: home sharing inside your primary residence with you on site, or a capped Vacation Rental permit. Whole-home vacation rentals are heavily constrained: the host must be an eligible resident who uses that dwelling unit as their primary residence, citywide permits are capped at 0.5% of housing units (currently 73), and applications run through a once-a-year 30-day window with a lottery when oversubscribed. A typical non-owner-occupied investment Airbnb does not qualify, and violations carry fines of $750 per day.

What the rules say in Poughkeepsie (City)

  • Permit required: it is only lawful to run a short-term rental (under 30 consecutive days) with a City-issued permit, and only two types exist, Home Sharing Rental and Vacation Rental (Sec. 19-5.47(2)(N), (3)(A)).
  • Host residency: every STR must have a Host, defined as an eligible resident of the dwelling unit offered, and an eligible resident is a resident or owner who uses that dwelling unit as his or her primary residence (Sec. 19-5.47(2)(D), (G)). The city's STR page confirms hosts must reside in the specific dwelling unit being rented.
  • Vacation Rental (whole-home, no resident on site during the stay) permits are capped each year at 0.5% of total housing units, currently 73 per the city (Sec. 19-5.47(4)(D)(2)(b)).
  • Vacation Rental applications are accepted only in a designated 30-day annual window (April 1-30 in 2026 per the city), with a lottery if applications exceed the cap; renewals are also subject to the cap and lottery, and permits are non-transferable (Sec. 19-5.47(4)(D)(2), (4)(G)(5), (4)(H)).
  • Home Sharing Rental (renting bedrooms in the host's primary residence while the host lives on site throughout the stay) applications are accepted year-round; the applicant must prove primary residence with two documents and self-certify they will be present during each visitor's stay (Sec. 19-5.47(2)(F), (4)(A)(2), (4)(B)(3)).
  • Operating conditions: building and fire inspection before the initial permit, occupancy limited to the permit, vacation rentals limited to one booking at a time, one visitor vehicle per rented bedroom, minimum $1,000,000 liability insurance or equivalent platform coverage, permit and host rules posted inside the unit, and hotel occupancy tax collected and remitted (Sec. 19-5.47(3)(A), (4)(A)(1)(h)).
  • Enforcement: violations are punishable by a fine of $750 per day, each day a new violation, plus payment of back occupancy taxes and remittance of illegally obtained rental revenue; hosting platforms are barred from collecting fees on non-compliant listings (Sec. 19-5.47(11), (7)).

How short-term rentals are regulated in New York

  • New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
  • Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
  • Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
