Short-term rentals under about 30 nights are effectively prohibited in the Village of Spring Valley. The village zoning code defines "dwelling" to expressly exclude tourist homes, hotels, motels, and boardinghouses, lists no short-term or transient rental use in any residential district, and deems any use not identified in the Use Table prohibited (Section 255-15). Transient lodging is allowed only as a hotel or motel by Village Board special permit in the HB and PLI commercial/industrial districts.
What the rules say in Spring Valley (Village)
- Zoning definition of "dwelling" (Section 255-6) excludes a boardinghouse, tourist home, hotel, motel, tourist cabin, summer colony or trailer, so transient lodging in a home is not a permitted residential use.
- "Dwelling unit" (Section 255-6) likewise excludes a hotel, inn, lodging, rooming house, or similar structure.
- Section 255-15(A): any use not identified in the Use Table is deemed prohibited; no short-term rental, tourist home, or transient lodging use is listed in any residential district (R-1, R-1A, R-2, R-3, R-4, R-5, RSH, PRD) in Appendix A.
- "Hotel" is defined as a facility offering transient lodging to the general public; hotels and motels are allowed only by special permit of the Village Board and only in the HB (Highway Business) and PLI (Planned Light Industrial) districts (Appendix A, Sections A-11 and A-12).
- A "boardinghouse" covers roomers or boarders staying more than occasionally and exceeding one month; room rentals under roughly 30 nights therefore fall on the transient (hotel) side of the line and are not permitted in residential zones.
- Local Law 5 of 2023 amended Section 255-6 to define "nontransient tenants" as hotel or motel occupants staying more than 30 consecutive days, confirming the village treats about 30 days as the transient threshold.
- No STR-specific permit or registration scheme exists in the village code; owners of non-owner-occupied buildings must designate an agent for service of process under Chapter 194.
- New York State's 2025 statewide short-term rental registry applies on top of local law but does not legalize a use the village zoning prohibits.

How short-term rentals are regulated in New York
- New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
- Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
- Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
- Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
