Bogota bans short-term rentals outright. Borough Code Section 9-15 makes it unlawful to accept payment for, or even advertise, occupancy of any dwelling unit for 30 days or less, so a typical whole-home Airbnb cannot operate legally here. Violations carry fines up to $1,250, with each day counting as a separate violation.

What the rules say in Bogota

  • Unlawful for any owner, lessor, sublessor, or other person to receive or obtain actual or anticipated consideration for soliciting, advertising, offering, or permitting occupancy of any dwelling unit for a period of 30 days or less (Sec. 9-15.1a).
  • Short-term rental is defined as any rental of a dwelling unit for less than 30 consecutive days (Sec. 9-15.2).
  • Rentals of more than 30 days remain lawful; the ban does not prevent an otherwise lawful occupancy for a rental period of more than 30 days (Sec. 9-15.1b).
  • Advertising, soliciting, or promoting a short-term rental by any means is itself a violation (Sec. 9-15.4).
  • Unpaid house guests who are part of the owner's housekeeping unit may stay 30 days or less; the ban targets paid stays (Sec. 9-15.3).
  • Enforced by the Building Code Official; a violation is declared a public nuisance, with a civil penalty up to $1,250 and each day counting as a new and separate violation, without regard to intent or knowledge (Sec. 9-15.5).
  • Adopted 6-8-2023 by Ordinance No. 1597; still in the current code, which includes legislation through 7-17-2025, with no later short-term rental amendment in the borough's new-laws list through April 2026.

How short-term rentals are regulated in New Jersey

  • New Jersey has no single statewide short-term-rental ban. Instead, each municipality sets its own rules through local ordinances, which is why neighboring Bergen towns can differ completely.

  • Common municipal controls include registration or permits, owner-occupancy requirements, minimum-stay rules, caps on rental nights, and zoning limits on which districts allow short-term use.
