Cedar Grove Township bans short-term rentals outright: since April 1, 2024 (Ord. No. 24-929, codified as Chapter 208, Article III), it is unlawful to rent, offer, or advertise any dwelling unit for 29 days or less anywhere in the township, whether whole-home or by the room. Rentals of 30 consecutive days or more remain lawful. Violations are a public nuisance with escalating fines of $500, $750, then $1,250, and each day counts as a separate offense.

What the rules say in Cedar Grove

  • Renting, offering, or permitting occupancy of any dwelling unit for consideration for a period of 29 days or less is prohibited township-wide (Code sec. 208-27).
  • The prohibition covers any dwelling unit offered or used for accommodations, lodging, cooking, sleeping, gathering, or entertaining for consideration for 30 days or less (definitions, sec. 208-26).
  • Advertising, soliciting, or promoting a short-term rental is itself unlawful (sec. 208-28), so listing on Airbnb/VRBO violates the code even without a booking.
  • Rentals of 30 consecutive days or more are expressly unaffected: nothing in the article prevents an otherwise lawful occupancy for a rental period of 30 days or more.
  • Violations are declared a public nuisance; enforcement is by the Building Code Official, Fire Official, Health Department, and other officials designated by the Township Council (sec. 208-29).
  • Penalties escalate: $500 first offense, $750 second, $1,250 third and each thereafter, and each day of violation is a separate offense.
  • Longer-term rental properties remain subject to the township's general rental-property provisions in Chapter 208.

How short-term rentals are regulated in New Jersey

  • New Jersey has no single statewide short-term-rental ban. Instead, each municipality sets its own rules through local ordinances, which is why neighboring Bergen towns can differ completely.
  • Statewide, short-term rentals are generally subject to NJ Sales Tax and the State Occupancy Fee (and, in some areas, local taxes) on stays under 90 days, unless booked through certain channels that collect on the host's behalf.
  • Common municipal controls include registration or permits, owner-occupancy requirements, minimum-stay rules, caps on rental nights, and zoning limits on which districts allow short-term use.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
