Jersey City allows short-term rentals (stays of 28 days or fewer) only with an annual STR permit from the Division of Housing Preservation, and only for owner-occupied principal residences. You may rent while you are away for at most 60 nights per calendar year; tenant hosting and rental arbitrage are banned outright, and STRs are barred in rent-controlled buildings and, when the owner is not present, in buildings with more than four units. A June 2025 amendment (Ord. 25-059) added a 275-day-per-year principal-residence test and capped any person or entity at two permits.

What the rules say in Jersey City

  • An annual STR permit from the Division of Housing Preservation is required before operating or even advertising; it is valid one year, non-transferable, and expires automatically on sale (Ch. 255, Sec. 255-2A, 255-3, 255-4).
  • The owner must be the principal resident: living at the property at least 275 days per year, documented by two of state ID/vehicle registration, tax documents, or a utility bill (Sec. 255-1, 255-2A).
  • Rentals while the owner is away are capped at 60 nights per calendar year; un-hosted rentals are prohibited in buildings with more than four dwelling units (Sec. 255-2E, 255-2F).
  • Tenants may not host or sublease short-term (arbitrage is banned, overriding any lease); STRs are prohibited in rent-controlled units; any person or entity may hold at most two permits (Sec. 255-2, 255-2C, 255-2G).
  • Fees are $250 initial and $200 annual renewal; applications require a Zoning Determination Letter, fire-safety inspection, $500k liability insurance, a 24/7 responsible party, and the permit number in every listing; fines run $100 to $2,000 per violation per day (Sec. 255-3, 255-6, 255-7).

How short-term rentals are regulated in New Jersey

  • New Jersey has no single statewide short-term-rental ban. Instead, each municipality sets its own rules through local ordinances, which is why neighboring Bergen towns can differ completely.
  • Statewide, short-term rentals are generally subject to NJ Sales Tax and the State Occupancy Fee (and, in some areas, local taxes) on stays under 90 days, unless booked through certain channels that collect on the host's behalf.
  • Common municipal controls include registration or permits, owner-occupancy requirements, minimum-stay rules, caps on rental nights, and zoning limits on which districts allow short-term use.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
