Short-term-rental rules

Can you Airbnb in Mamaroneck (Town), NY?

Effectively prohibited

Researched and reviewed by Jake Lee, FounderCurrent as of July 2026How this atlas is maintained

The unincorporated Town of Mamaroneck has no short-term-rental law, but its zoning code is permissive: any use not specifically permitted is prohibited (sec. 240-10), no district permits transient lodging, "dwelling" is defined to exclude hotels, rooming houses and tourist homes, and homes may keep at most two nontransient roomers. Sub-30-night rentals are therefore not a permitted use in the unincorporated town, though the town has historically not enforced aggressively. Properties in the Villages of Mamaroneck or Larchmont follow those villages' own codes instead.

What the rules say in Mamaroneck (Town)

  • Town Code sec. 240-10 (Conformance required): "Any use not specifically permitted by this chapter is prohibited." No zoning district in the unincorporated town lists short-term rental, tourist home, bed-and-breakfast, hotel or motel as a permitted, special or accessory use (checked Article IV residence districts and Article V business/industrial districts).
  • Sec. 240-4 defines DWELLING to exclude "a motel, hotel, rooming house or tourist home," and HOME OCCUPATION expressly excludes operating a tourist home or rooming house from a dwelling.
  • Sec. 240-21C(2): the only room-rental allowance in residence districts is keeping "not more than two nontransient persons as roomers or boarders" with no sign and no separate cooking facilities, so renting rooms to transient (short-stay) guests is outside the permitted accessory use.
  • There is no STR registration, rental permit, or transient-occupancy chapter anywhere in the town code; eCode360 full-text searches for "short-term rental" and "transient" return no STR provision, and the four uncodified 2026 local laws (LL-1-2026 through LL-4-2026) are unrelated to rentals.
  • Whole-home rental to a single household under 30 nights is not squarely addressed by the code; the prohibition rests on the catch-all permissive-use clause plus the transiency exclusions, and 2020 press reporting indicates the town had discussed but never adopted STR rules and saw little enforcement, so treat this as an implicit bar and confirm with the Building Department before operating.
  • This applies only to the unincorporated Town of Mamaroneck; the Village of Mamaroneck and Village of Larchmont, which lie within the town's boundaries, have their own separate zoning codes.
  • Chapter 137 (Motels) regulates operation of motels (register, management duties) but does not create any path for short-term rental of dwellings.

How short-term rentals are regulated in New York

  • New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
  • Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
  • Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
