What the rules say in Milan

  • Sec. 200-36(C)(5): A non-primary-residence STR existing on the law effective date may continue as a nonconforming use only with proof of prior activity and an application filed within 60 days; if its certificate lapses, the nonconforming use cannot be re-established.
  • Sec. 200-36(C)(7): The certificate application requires a copy of a current Dutchess County hotel occupancy tax certificate, and for unhosted rentals proof the property is the owner's primary residence.
  • Sec. 200-36(C)(8): A short-term rental certificate terminates upon sale or transfer of ownership of the property.
  • Sec. 200-36(D)-(E): One off-road parking space per rented bedroom is required, and all advertising must state the occupancy limits and the Town of Milan registration number.
