The Town of Mount Pleasant bans short-term rentals outright: Town Code § 218-20.6 (adopted 1-24-2023 by Local Law No. 1-2023) makes it unlawful to rent, or offer to rent, any living accommodations for fewer than 30 consecutive nights anywhere in the town, whole-home or by the room. The only carve-out is for lawfully licensed commercial hotel/motel (and hospital) establishments, so Airbnb-style rentals of homes are not legal in the unincorporated town.

What the rules say in Mount Pleasant (Town)

  • Town-wide prohibition: it is unlawful to rent or license, or offer to rent or license, any living accommodations for monetary compensation for a period of less than 30 consecutive nights unless the use is lawfully licensed or permitted under the Town Zoning Code (Town Code 218-20.6B(1)).
  • "Short-term rental" is defined as a dwelling unit rented, in whole or in part, for less than 29 consecutive nights, and expressly includes time-share and similar occupancy arrangements; "transient" means a rental period of 29 nights or less (218-20.6A).
  • The prohibition applies to all properties within the town, and covers both hosts and guests: no occupant may stay under 30 nights for compensation, and a renter of an illegal STR is deemed an accessory to the offense (218-20.6B(2), B(5), C(1)).
  • Exception: the ban does not apply to a commercial hotel/motel business (or hospital establishments) operating exclusively as such and lawfully licensed or permitted under the Town Zoning Code (218-20.6C(2)).
  • Enforcement: first a warning from the Building Inspector, then fines of $250 (first offense), $500 (second) and $1,000 (each subsequent); each week a violation continues can constitute separate additional violations, and the town may also seek injunctive relief (218-20.6B(6)-(7)).
  • Lease clauses purporting to waive the section are unlawful (218-20.6B(3)).
  • Adopted 1-24-2023 by Local Law No. 1-2023 as part of Chapter 218 Zoning, Article II Supplemental Regulations.
  • Layering note: this town code governs the unincorporated Town of Mount Pleasant (Valhalla, Thornwood, Hawthorne, etc.); the villages within the town (e.g., Sleepy Hollow, Pleasantville) have their own separate codes.

How short-term rentals are regulated in New York

  • New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
  • Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
  • Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
