Short-term rentals allowed

Researched and reviewed by Jake Lee, FounderCurrent as of July 2026How this atlas is maintained

Town of North East (Millerton area) has no short-term-rental law: whole-home rentals under 30 days face no town permit, registration, day cap, or owner-occupancy requirement. The one hard limit is that accessory dwelling units cannot be short-term rented (90-day minimum term under Sec. 180-60C(2), adopted April 2026). Note the zoning definition of 'dwelling' excludes structures used for transient habitation, and the town's Phase Two residential zoning overhaul is expected to take up STR regulation, so rules may tighten.

What the rules say in North East

  • No dedicated STR law: Town of North East's Chapter 180 Zoning, including the Phase One amendments adopted as Local Law 1 of 2026 (April 9, 2026), contains no short-term-rental chapter, permit, registration, day cap, or minimum-stay rule for whole dwellings.
  • Sec. 180-60C(2) (Local Law 1 of 2026): the minimum rental term of an Accessory Dwelling Unit is 90 consecutive days, so ADUs cannot be used as short-term rentals.
  • Sec. 180-60C(1)(a) (Local Law 1 of 2026): an ADU permit requires the property owner to occupy either the principal dwelling or the ADU, with a notarized affidavit filed with the application.
  • Chapter 180 Definitions ('Dwelling', as re-adopted in Local Law 1 of 2026): a dwelling 'shall not include tourist homes, mobile homes, motels, hotels, or other structures designed, used or rented for transient habitation' - a definitional gray area an aggressive code officer could cite against a full-time transient-use house, though the town has no STR enforcement scheme built on it.
  • Pending: the town split its zoning rewrite into two phases; Phase One (commercial districts) is in effect, and a Phase Two residential-code overhaul is next, where residents (including a Millerton ZBA member) have publicly pushed for controls on short-term rentals (Millerton News, Feb 2026 public-hearing coverage). Expect possible STR regulation in Phase Two.

How short-term rentals are regulated in New York

  • New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
  • Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
  • Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
