Can you Airbnb in Briarcliff Manor, NY?
Researched and reviewed by Jake Lee, FounderCurrent as of July 2026How this atlas is maintained
Briarcliff Manor has no short-term-rental law, but its zoning code is permissive-only: homes in every residence district may be used solely as a single-family dwelling for one housekeeping unit, room rentals are limited to nontransient roomers or boarders, and transient lodging (hotels) is allowed only by special permit in the CT commercial-transition districts. Under-30-night whole-home or room rentals therefore have no permitted-use pathway in the Village's residential zones.
What the rules say in Briarcliff Manor
- Permissive zoning: §220-4C states that only uses specifically listed as permitted in the district schedule are permitted anywhere in the Village.
- In all single-family residence districts (RT4B, R80A, R60A, R40A, R40B, R30A, R20A, R20B, R12B, R10B) the only principal uses are a single-family dwelling 'for only one housekeeping unit', §220-6 special permit uses, and municipal/park uses (220 Attachment 1, Table 1).
- Room rentals: the only lodging accessory use in residence districts is 'the keeping of not more than four nontransient roomers or boarders by a resident family' (Table 1), transient (short-stay) room rentals are excluded.
- 'Tourist home' is expressly excluded from the home-occupation definition (§220-2), and no bed-and-breakfast or STR use is defined or listed in any residential district or among §220-6J residence-district special uses.
- Hotels, defined in §220-2 as buildings with rooms 'occupied by transient guests', are allowed only by special permit in the CT Complementary Use Transition districts (§220-6M(2)(l)); 'short-term executive housing' is allowed only as a CT-district accessory use of up to 25 units for business travelers.
- No STR registration, rental permit, or transient-rental chapter exists anywhere in the Village code (verified against the full chapter list and the uncodified 2026 local laws: L.L. 1-2026 affordable housing, L.L. 3-2026 PUD/trees/wetlands).
- The Village imposes a 3% hotel room occupancy tax on stays; occupants of 30+ consecutive days are exempt as 'permanent residents' (§§195-29 to 195-50, effective Jan 1, 2023). This is a revenue law and does not authorize transient rental use in residential zones.

How short-term rentals are regulated in New York
- New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
- Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
- Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
- Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
