Short-term-rental rules

Can you Airbnb in Mahwah, NJ?

Effectively prohibited

Researched and reviewed by Jake Lee, FounderCurrent as of July 2026How this atlas is maintained

Mahwah has no short-term-rental ordinance and no STR permit or registration system, but its zoning code states that any use not specifically designated as permitted, accessory, or conditional "is specifically prohibited from any zone district" (Sec. 24-3.1a), and short-term rental is not a designated use anywhere in the code. Transient lodging is captured by the HOTEL definition and allowed only as a conditional use in nonresidential zones (Sec. 24-7.8), while residential occupancy is defined around a FAMILY of "permanent, stable and domestic character as distinguished from ... transient housing." Under-30-night rentals of homes or rooms are therefore not a permitted use in Mahwah's residential zones; this is an implicit bar by zoning structure rather than an express STR ban, so an owner should confirm the Zoning Officer's position before assuming any operation is viable.

What the rules say in Mahwah

  • Zoning Sec. 24-3.1(a) (permissive-exclusive clause): any use not specifically designated as a principal permitted use, accessory use, or conditional use is 'specifically prohibited from any zone district in the Township'; short-term rental is not a designated use in any zone (verified against code text current through 12-29-2025).
  • Residential zones (R80-R5, R11) permit only dwellings, home occupations, and similar uses per Attachment 4, Schedule of District Use Regulations; no lodging, boarding, or short-term rental use is listed.
  • Sec. 24-1.5 defines FAMILY as a single housekeeping unit of 'permanent, stable and domestic character as distinguished from non-familial institutional uses, boarding homes ... transient housing or other similar forms of housing'; HOTEL is defined as 'a facility offering transient lodging accommodations to the general public.'
  • Hotels/motels (transient lodging) are conditional uses only in business and OP200 office-park zones under Sec. 24-7.8, not in any residential zone.
  • No STR ordinance was adopted in 2024, 2025, or 2026 (checked the Township's full adopted-ordinance lists); the 2025 Certificate of Continued Occupancy ordinance (Ord. 2065, codified at Sec. 10-10) applies to sales/listings/change of use of 1-2 family homes, and the Township states it does not require a CCO for tenant rentals.
  • Rental dwellings generally (long-term) are subject to lead-based paint inspections (Sec. 10-9, per N.J. P.L.2021 c.182), state-mandated liability-insurance registration of rental units with the Township Clerk (Ch. 4), and NJ Uniform Fire Code smoke/CO alarm certification at tenant change.

How short-term rentals are regulated in New Jersey

  • New Jersey has no single statewide short-term-rental ban. Instead, each municipality sets its own rules through local ordinances, which is why neighboring Bergen towns can differ completely.
  • Statewide, short-term rentals are generally subject to NJ Sales Tax and the State Occupancy Fee (and, in some areas, local taxes) on stays under 90 days, unless booked through certain channels that collect on the host's behalf.
  • Common municipal controls include registration or permits, owner-occupancy requirements, minimum-stay rules, caps on rental nights, and zoning limits on which districts allow short-term use.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
