Short-term rentals are not a permitted use in the Village of Chestnut Ridge. Village zoning (Chapter 290) allows only family residences in its residential districts, expressly defines "residence" to exclude tourist homes, hotels, motels and tourist cabins, limits room rentals to 2 nontransient roomers by Village Board special permit, and deems any use not identified in the Use Table prohibited, so whole-home or room rentals under 30 nights to transient guests have no legal pathway in a home.

What the rules say in Village of Chestnut Ridge

  • Zoning Ch. 290, §290-10F: "Any use not identified in the Use Table shall be deemed prohibited." No short-term rental, tourist home, or bed-and-breakfast use is identified anywhere in the Use Table.
  • Residential districts (RR-50, R-40, R-35, R-25, R-20, R-15, R-15 1F, R-10, RSH) permit only 1-family detached residences by right; 2-family and 1-family semi-attached residences are conditional uses only in R-15 and R-10 and must have at least one unit owner-occupied (290 Attachment 1).

  • Hotels/motels (defined as transient accommodations for 10 or more persons) are allowed only as Planning Board conditional uses in the nonresidential LO, PILO and RS districts, subject to §290-66 standards and located at least 1,200 feet from any residence district (290 Attachment 2).
  • Rental Registry Law (Ch. 203 Property Registration, Art. II, adopted by L.L. No. 4-2017): owners of non-owner-occupied 1- and 2-family rental dwellings must register with the Building Department; registration is valid 2 years; owner-occupied premises are exempt. It contains no short-term rental authorization and defines "reside" as dwelling more than 14 days.
  • No STR-specific local law has been adopted by the village as of mid-2026 (verified against the village's posted local laws and the eCode360 code through its Feb 2023 supplement, plus news/web searches).
