No. MC 3824) prohibits renting any residential premises, or any rooms in them, for less than 30 days; only duly licensed hotels and motels are exempt. Even advertising a sub-30-day rental is unlawful, with fines up to $1,000 per day.

What the rules say in Irvington

  • § 510-2A: No residential premises, including dwelling houses, apartments, rooming houses or boarding houses or any parts thereof or rooms therein, except duly licensed hotels and motels, may be rented or let for occupancy for a period of less than 30 days. This bans both whole-home and room STRs.
  • § 510-2B: It is unlawful for an owner, lessor, sublessor, or anyone with possessory or use rights (or their agents) to receive or seek any consideration for offering or permitting occupancy of a dwelling unit for less than 30 days.
  • § 510-1 defines SHORT-TERM RENTAL as rental of a dwelling unit or any part of it (including accessory buildings or even a vehicle parked on the property) for 30 consecutive days or less, excluding community residences, shelters, adult family care homes, an owner temporarily displaced by construction on another Township property, and month-to-month extensions of an existing lease of at least six months.
  • § 510-2C and D: Rentals longer than 30 days, and month-to-month continuations of a prior lawful lease, remain lawful.
  • § 510-3: Unpaid house guests who are members of the owner's housekeeping unit may stay 30 days or less; only occupancy without consideration is permitted.
  • § 510-4: Advertising, soliciting, or promoting a short-term rental in violation of the chapter is itself unlawful (newspapers, flyers, internet websites, electronic messages, etc.).
  • § 510-5: Violations are declared a public nuisance per se; strict liability (no intent or knowledge required); fine up to $1,000, and each day of violation is a separate violation. Enforced by the Building Code Official, Fire Official, Health Department, and other code officials.
