Carmel's zoning code, adopted March 5, 2025, only allows short-term rentals in owner-occupied single-family homes, so a typical non-owner-occupied whole-home Airbnb does not qualify at all. Owners who do qualify need a special use permit and site plan approval from the Planning Board plus a Building Department license, and the lot must be at least 3 acres. What the rules say in Carmel

  • An STR is defined as a single-family detached OWNER-OCCUPIED dwelling (or accessory building on the same lot) rented for no more than 14 consecutive days; hotels, campsites, and glamping are excluded (§ 156-8 definition). Non-owner-occupied whole-home rentals fall outside the definition.

  • An STR is not permitted if access is only from a private road; the driveway must have direct access to a public road over the owner's land (§ 156-36.4.B(4)).
  • Operational requirements: guest registry and financial records, no outdoor large gatherings/weddings/events, 1 extra parking space per rented bedroom, regular waste removal, certification that well and septic can handle the added load, and a Planning-Board-approved good-neighbor brochure posted on any listing site (§ 156-36.4.B(6)-(11), (15)).
  • The Town Board may cap the total number of STRs in the town by resolution (§ 156-36.4.B(16)).
  • Existing unpermitted operators had 90 days from the effective date to apply; operating without approval after that is a violation requiring immediate cessation (§ 156-36.4.B(17)).
  • Penalties escalate from up to $500 (first conviction) to $1,000 plus 6-month suspension, $1,500 plus 1-year suspension, then revocation of the permit and special use permit (§ 156-36.4.B(18)).
