What the rules say in Hillburn (Village)

  • Zoning Chapter 250, § 250-7 (Terms defined) defines SHORT-TERM RENTAL as the rental of any residence for less than 30 consecutive days to a non-occupant visitor of the dwelling, and expressly states: "A short-term rental is a prohibited use."
  • The prohibition applies whether or not the rental is for commercial gain, and even to home-swap arrangements ("in exchange to gain rental occupancy in a residence within or outside the Village").
  • The ban covers the rental of "any residence", so it reaches both whole-home and room rentals under 30 nights, village-wide in all districts.
  • The definition of RESIDENCE excludes motels, hotels, boarding houses, inns, lodging and similar places of habitation, and the FAMILY definition excludes transient housing, reinforcing that transient occupancy is not a residential use.
  • The only transient-lodging use defined in the code is "Hotel, resort" (a commercial use with guest sleeping rooms, allowed only under specific district and bulk standards such as § 250-18.R), which is not a pathway for renting out a home.
  • Rentals of 30 consecutive days or longer fall outside the short-term rental definition and are not barred by this provision.
