What the rules say in North Haledon
- Sub-30-day paid stays are unlawful: it is illegal for any owner, lessor, sublessor, or agent to receive or anticipate consideration for soliciting, advertising, offering, or permitting occupancy of any dwelling unit for a period of 30 days or less (Ch. 463, Art. II, adopted by Ord. No. 22-2016 on 12-7-2016).
- The prohibition covers the whole dwelling-unit spectrum: apartments, condominiums, buildings, co-operatives, converted spaces, or portions thereof offered for lodging, sleeping, gathering, or entertaining for consideration for 30 days or less.
- Advertising a short-term rental is itself a violation: it is unlawful to advertise, solicit, or promote by any means (newspapers, flyers, internet websites, electronic messages, etc.) occupancies prohibited by the article (section titled 'Advertising prohibited').
- Penalty: a civil fine up to $1,250 per violation, with each day counting as a new and separate violation, without regard to intent or knowledge; violations are declared a public nuisance per se, and the borough may also pursue injunctions and attorney's fees.
- Only exception: unpaid house guests. Occupancy of 30 days or less by a member of the owner's housekeeping unit, without consideration, is permitted (section titled 'Permitted uses').
