Short-term-rental rules
Can you Airbnb in Oradell, NJ?
Researched and reviewed by Jake Lee, FounderCurrent as of July 2026How this atlas is maintained
Oradell has no short-term-rental ordinance and no permit path; its zoning code instead shuts STRs out structurally. Section 240-6.12A(7) prohibits hotels, motels, boardinghouses and bed-and-breakfast facilities in ALL zones, every district's permitted-use list is exclusive ("all other uses not set forth above are prohibited"), and dwellings may only be occupied by a "family" defined as a single housekeeping unit of "permanent and domestic character, as distinguished from... transient associations," so whole-home or room rentals under 30 nights are not a permitted use anywhere. Ordinary (longer-term) rentals are legal but require a certificate of continued occupancy and a rental inspection at every change of tenancy with 20 days advance notice (Ch. 85).
What the rules say in Oradell
- No STR-specific ordinance exists: full-code searches for "short-term rental" and "transient" return no STR provision, the TOC has no rental-licensing or lodging chapter, and none of the 18 recently adopted ordinances (through Ord. 26-6, adopted 2026-03-10) touches STRs.
- Zoning Sec. 240-6.12A(7): "Hotels, motels, boardinghouses and bed-and-breakfast facilities" are prohibited in all zones, which bans the room-rental/B&B hosting model borough-wide.
- Zoning definitions (Sec. 240-2.2): "Dwelling" expressly excludes hotels, motels, lodging houses, boardinghouses and tourist homes; "Family" must be a "single, nonprofit housekeeping unit whose relationship is of a permanent and domestic character, as distinguished from... rooming houses, boardinghouses, specialized housing and other forms of transient associations"; "Rooming house" is any building renting sleeping accommodations for compensation to non-family members.
- Every zoning district's use list is exclusive, e.g. Sec. 240-6.5A(3) for R-1: "All other uses not set forth above are prohibited in this zone"; residential zones permit only one-family dwellings, two-family dwellings, garden apartments, community residences and family day-care homes, so transient occupancy is not a permitted use in any district; the Conditional Uses article contains no lodging use.
- Ch. 85 (Sec. 85-2, and Sec. 85-2.1 added by Ord. 22-12 in 2022): any change of residential tenancy or occupancy requires a certificate of continued occupancy, and every rental dwelling unit must be inspected by the rental inspection officer before rental or reoccupancy, with written notice at least 20 days before the occupancy change and lead-based-paint inspection at each tenant turnover or every 3 years, a regime that applies to all rentals and is operationally incompatible with sub-30-night stays.

How short-term rentals are regulated in New Jersey
- New Jersey has no single statewide short-term-rental ban. Instead, each municipality sets its own rules through local ordinances, which is why neighboring Bergen towns can differ completely.
- Statewide, short-term rentals are generally subject to NJ Sales Tax and the State Occupancy Fee (and, in some areas, local taxes) on stays under 90 days, unless booked through certain channels that collect on the host's behalf.
- Common municipal controls include registration or permits, owner-occupancy requirements, minimum-stay rules, caps on rental nights, and zoning limits on which districts allow short-term use.
- Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
