Short-term-rental rules
Can you Airbnb in Scarsdale (town/village), NY?
Researched and reviewed by Jake Lee, FounderCurrent as of July 2026How this atlas is maintained
Scarsdale has no short-term-rental law, but its zoning permits homes in the Residence A districts that cover nearly all of the village to be used only as one-family dwellings, with room rentals expressly limited to at most three "nontransient" boarders or roomers and no advertising on the premises. Transient lodging is recognized only as a hotel or lodging house use in Residence C (multifamily) districts, so typical Airbnb-style rentals under 30 nights are not a permitted use in single-family Scarsdale; whole-home short lets to a single family fall into a gray area the code does not expressly address.
What the rules say in Scarsdale (town/village)
- No STR-specific ordinance: the Village Code (current through Feb 2026) has no short-term-rental, transient-occupancy, rental-registration, or hotel-licensing chapter; verified against the full chapter list.
- Zoning Code sec. 310-7 makes Residence A district use lists exclusive: no building or premises may be used for any except the listed purposes, chiefly a detached dwelling for not more than one family on one lot.
- Room rentals are allowed only for NONTRANSIENT boarders or roomers, capped at three per dwelling unit, with no display or advertising on the premises (sec. 310-7A); transient (short-stay) room rentals are therefore not a permitted use in residence districts.
- Transient lodging appears in the code only as a hotel or lodging house, permitted solely in Residence C multifamily districts subject to sec. 310-70 (sec. 310-9C).
- The zoning definitions (sec. 310-2) contain no short-term rental, transient, tourist home, or bed-and-breakfast terms and no minimum lease term, so a whole-home rental to one family for under 30 nights is not expressly addressed; confirm with the Village Building/Planning Department before operating.
- Zoning violations carry escalating penalties under the 2024 land use local law: fines from $500 up to $6,000 plus possible 15-day imprisonment for repeat offenses, far higher for corporate offenders, with each day a separate violation and possible civil penalties up to $50,000.
- Scarsdale is a coterminous town/village, so the Village Code applies to the entire municipality; New York State separately requires sales/occupancy tax collection on short-term rental stays (platforms collect since March 2025).

How short-term rentals are regulated in New York
- New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
- Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
- Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
- Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
