Short-term rentals are banned outright in Weehawken. Ordinance No. 19-2022 (adopted December 21, 2022, codified at Revised General Ordinances section 9-15) makes it unlawful to rent, lease, sublease, or even advertise any "guest living space" (a whole unit or individual rooms) for any period of less than a month, replacing the township's earlier annual STR permit system. Only rentals of a month or longer, or licensed hotels/motels/rooming/boarding houses, are lawful; violations carry fines of $1,000 to $2,000 and up to 90 days imprisonment per offense.

What the rules say in Weehawken

  • Township-wide ban: Ord. No. 19-2022 (adopted 12-21-2022) added section 9-15 to Chapter 9 (Building and Housing) of the Revised General Ordinances, prohibiting all short-term rental activity in Weehawken.
  • Prohibited activities (sec. 9-15.3): it is unlawful to rent, lease, sublease, provide for any consideration, OR advertise any 'guest living space' in the township. Merely advertising a listing is itself a violation.
  • Covers whole homes AND room rentals: 'guest living space' is defined as one or more rooms 'whether same constitutes an independent housing unit or not,' furnished or unfurnished, occupied for sleeping or living for hire for a short term (sec. 9-15.2).
  • 'Short-term' means any period of less than one full month of consecutive days (e.g., the 15th of one month to the 15th of the next counts as a month), so all rentals under roughly 30 consecutive nights are banned (sec. 9-15.2).
  • Exemptions (sec. 9-15.1): licensed hotels, motels, rooming or boarding houses (regulated separately), and occupancies governed by New Jersey landlord-tenant law (N.J.S.A. Title 2A, Subtitle 4, Ch. 18, Art. 9).
  • Penalties (sec. 9-15.4): first offense up to $1,000 fine and/or up to 90 days imprisonment; second offense up to $1,500; third or subsequent up to $2,000, each with possible 90 days imprisonment; each violation is a separate and distinct offense.
  • No permit path exists: the pre-2023 annual STR permit system was eliminated by the ban; no STR registration or license is available.
  • No repeal or replacement ordinance found through July 2026; the township's most recent housing ordinances (18-2025 and 19-2025, adopted 9-10-2025) amend rent control only and leave the STR ban intact.

How short-term rentals are regulated in New Jersey

  • New Jersey has no single statewide short-term-rental ban. Instead, each municipality sets its own rules through local ordinances, which is why neighboring Bergen towns can differ completely.
  • Statewide, short-term rentals are generally subject to NJ Sales Tax and the State Occupancy Fee (and, in some areas, local taxes) on stays under 90 days, unless booked through certain channels that collect on the host's behalf.
  • Common municipal controls include registration or permits, owner-occupancy requirements, minimum-stay rules, caps on rental nights, and zoning limits on which districts allow short-term use.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
