Short-term rentals (stays of 1-30 days) are legal in the Village of Croton-on-Hudson but must be registered: Local Law No. 16 of 2025 (adopted Oct. 8, 2025) added a Rental Unit Registry (Village Code Ch. 186, Art. What the rules say in Croton-on-Hudson
- Registration required: no rental unit may be occupied or let until the owner registers with the Village and obtains a rental unit registration certificate as either a rental unit or a short-term rental unit (Ch. 186 § 186-5(A), added by L.L. No. 16-2025, adopted 10-8-2025).
- "Short-term rental" is defined as a rental unit let by lease, license or other agreement for a period of between 1 and 30 days (Ch. 186 § 186-4).
- Owner-occupied properties with two or fewer dwelling units are exempt from the registry only if they are NOT short-term rentals, so every STR must register; hotels, motels, inns and bed-and-breakfasts are separately exempt (Ch. 186 § 186-5(A)(1)).
- Certificate conditions: a Village housing-code inspection and current real property taxes are required for issuance (§ 186-5(B)); an STR certificate expires after 1 year and must be renewed (regular rental certificates last 3 years) (§ 186-11); the certificate must be posted and a copy given to occupants (§ 186-14).
- Advertising a property on Airbnb, HomeAway, VRBO or similar sites creates a rebuttable presumption that the premises contains a rental unit subject to the registry (§ 186-6).
- Penalties for unregistered rentals: general Code penalties plus doubled registration fee 30 days after the due date, a summons and $75 fine after 60 days, and a possible notice to vacate; revocations are appealable to the Zoning Board of Appeals (§§ 186-13, 186-15, 186-17).
- Zoning (Ch. 230) residential districts use exclusive permitted-use language; hosted room rental as a "bed-and-breakfast establishment" (a dwelling renting rooms to transient paying guests) is allowed in one-family residence districts only by special permit from the Board of Trustees, with owner full-time residency, max 2 guest bedrooms, max 6 guests per night, max 15-day stays per guest, 3 off-street parking spaces, no accessory apartment, and 1,000-ft separation between B&Bs (§ 230-9.1A(10)(h)).
- Zoning definitions require occupancy of a dwelling unit by a "family" that is "permanent and stable, and not transient or temporary," and exclude hotels/boarding houses from the definition of dwelling unit (Ch. 230 Definitions), so STR use must still be consistent with the lawful use of the dwelling.
- The village has been pursuing a hotel/motel occupancy tax intended to include short-term rentals (Local Law Introductory No. 4 of 2026, public hearing Feb. 2026, pending state enabling legislation A8348); not confirmed adopted as of July 2026.
