What the rules say in Rhinebeck (Town)

- Sec. 125-147(C) and Chapter 125 Attachment 2, Note 10: STRs are a permitted use in all zoning districts subject to the STR permit, except the Rhinecliff Hamlet (Rc-H), Rhinecliff Hamlet Transition (Rc-HT), Rhinecliff Business (Rc-B), and Rhinecliff Overlay (Rc-O) Districts, which also require a special use permit from the Planning Board, renewed each year.
- Sec. 125-148(A)(9): minimum of one off-street parking space per bedroom shown on the floor plan; no on-street parking is permitted.
- Sec. 125-148(A)(10)-(11): maximum occupancy is two people per bedroom (plus two per full-size convertible sleeping furniture), never more than 12 people including permanent residents; on septic systems, overnight occupancy may never exceed 10 people total.
- Sec. 125-148(B): applicants must carry liability insurance rating the premises as a short-term rental and naming the Town as an additional insured; no permit issues without proof.
- Sec. 125-147(A)(5): the application must designate a contact person authorized to remedy violations who responds to the Code Enforcement Officer within 24 hours.
- Sec. 125-149(B)-(C): adjacent property owners are notified of each application and given 10 days to comment; the Code Enforcement Officer then has 30 days to inspect the property (fire and code) before approval, with all inspection fees paid by the applicant.
- Sec. 125-150(A)(4): the STR permit number must be conspicuously displayed in all advertisements for the rental.
- Sec. 125-151(G) and (I): court-imposed fines run $750 (first violation), $2,000 (second), $5,000 (third), plus a civil penalty of $250 per day for each day a violation continues; each day is a separate violation (Sec. 125-151(E)).
- Sec. 125-153(A): permits may be immediately suspended for falsified applications, non-compliance, code or Penal Law violations tied to the rental, neighborhood disturbances, or removal/disrepair of safety devices; revocation bars a new permit on the property for one year (Sec. 125-151(F)(5)).
