Short-term-rental rules

Can you Airbnb in Tivoli (Village), NY?

Heavily restricted

Researched and reviewed by Jake Lee, FounderCurrent as of July 2026How this atlas is maintained

Village of Tivoli sharply restricts short-term rentals under Chapter 180 of the Village Code (Local Law A, adopted August 14, 2024). Unhosted STRs are prohibited in every zoning district: the owner must be on site during guest stays, so a dedicated whole-home, non-owner-occupied Airbnb does not qualify. Hosted STRs require an annual operating permit from the Zoning Enforcement Officer, capped at 15 permits village-wide in the first year (first-come, first-served), with a 60-rented-day annual limit in most districts.

What the rules say in Tivoli (Village)

  • Ch. 180, Code of the Village of Tivoli (Local Law A of 2024, adopted 8/14/2024): unhosted short-term rentals are prohibited in all zoning districts; only hosted STRs, with the property owner present on site during guest stays, are eligible for permits.
  • Ch. 180: it is unlawful to operate, rent, or advertise a hosted STR without an annual operating permit issued by the Zoning Enforcement Officer, plus any required Chapter 231 (Zoning) approvals; each owner may hold only one permit, and only 15 permits are issued village-wide in the first year on a first-come, first-served basis.
  • Sec. 180-4 (Operating standards and supplemental regulations): hosted STRs may be rented no more than an aggregate of 60 days per calendar year, except in the GB and RB districts where no day limit applies.
  • Sec. 180-4: no recreational vehicle, bus, camping or travel trailer, or temporary housing (including tents and treehouses) may be used as an STR; accessory dwelling units may not themselves be rented as STRs, though an owner occupying an ADU may rent the primary home hosted.
  • Ch. 180: annual permits are denied to owners/properties with outstanding notices of violation, or with a permit suspended or revoked and uncured, or suspended/revoked two or more times in the preceding two years; police, the Zoning Enforcement Officer, and the Building Inspector may issue appearance tickets for violations.

How short-term rentals are regulated in New York

  • New York has no single statewide short-term-rental ban. Towns, villages, and cities set their own rules through local ordinances and zoning, so rules can differ sharply between neighboring municipalities in the same county.
  • Short stays in New York are generally subject to state and local sales tax, and many counties add a local occupancy (hotel/motel) tax, often collected by the booking platform on the host's behalf.
  • Common local controls include permits or registration, primary-residence requirements, and zoning limits on which districts allow short-term use. In New York, a town and a village inside it can each have their own rule.
  • Rules change. An ordinance can be added or amended at any time. Always confirm the current rule with the municipality before listing.
